Dirtybird Rocket Surgery Remix Contest - Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN. 2. ELIGIBILITY RESTRICTIONS: All Contest entries must comply with the requirements of these official rules to be eligible to participate. 3. ENTRY DATES AND DEADLINES: Contest opens at 12:00 a.m. Eastern Daylight Time on July 15, 2008 and closes at 11:59 p.m. Eastern Standard Time on September 15, 2008. Entries must be received on or before 11:59 p.m., on September 15, 2008. 4. TO ENTER: Download the remix project from this site. Create a remix of The Martin Brothers song "Dum" and upload a 320kbps MP3 (44.1Khz Constant Bit Rate, Normal Stereo) file of your remix along with your name, email and the title of your remix, to the contest website at www.dirtybirdremix.com. Official contest hosted by Dancetracks Digital. By participating, entrants agree to abide by these official Contest rules and warrant that they meet the eligibility requirements set forth herein. 5. GENERAL CONDITIONS: Entrant may submit multiple entries. Dirtybird Records, The Martin Brothers and Dancetracksdigital are not responsible for lost, late, damaged, misdirected, illegible, incomplete entries, interrupted or unavailable network, server, Internet or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic or for exposure to computer viruses or for damage to participant's computer by accessing the websites www.dirtybirdremix.com or www.dancetracksdigital.com. Without limiting anything to the contrary contained herein, The Martin Brothers, Dirtybird Records and Dancetracks Digital makes no warranty that any particular remix/sequencing software program will function as required for this Contest. It is your sole responsibility to ensure that your recording/remix system(s) functions correctly. Entrants hereby represent and warrant that all of the music, vocals or additional lyrics included in their remixes (other than the "Dum" multitracks provided on the www.dirtybirdremix.com "www.dancetracksdigital.com) are wholly original and that no music, vocals or lyrics have been copied from any other source or otherwise violate any third party rights. Sponsors will not be responsible or held liable for any music, vocals or lyrics which are included in any submitted materials which have been copied from any other source. Entries are the property of Dirtybird Records. You hereby agree not to duplicate, sell or exploit any portion of the entry or the original master recordings at any time without Dirtybird Records prior specific written consent. Dirtybird Records reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Dirtybird Record's reasonable control impairs the integrity of the Contest as determined by Dirtybird Records in its sole discretion. Dirtybird Records reserves the sole right to extend the deadline of the determinations of the winning entries for one extension period of thirty (30) days. By entering this contest, you expressly agree that all of the results and proceeds of the Contest entry are and shall be, from the inception of creation, a "work made for hire" for Dirtybird Records . You further acknowledge, certify and agree that Dirtybird Records shall be deemed the author and/or exclusive owner throughout the world of any and all rights in and to the entry (including, but not limited to, the right, title and interest in and to the worldwide copyrights in the "sound recording(s)" (as defined in the Copyright Act of the United States of America) and underlying composition embodied therein and any renewal or extension of rights in connection therewith), and of any and all other rights thereto. In the event that the services rendered in connection with the entry are not deemed to be "works made for hire", then the rights therein shall be deemed irrevocably transferred to Dirtybird Records by virtue of this agreement. You will, upon request, execute, acknowledge and deliver to Dirtybird Records such additional documents as Dirtybird Records may deem necessary to evidence and effectuate Dirtybird Record's rights hereunder. If you are under the age of 18, you and your parent or legal guardian warrant and represent that you and your parent or legal guardian have both reviewed and expressly agreed with these official Contest rules. Dirtybird Records reserves its rights to verify eligibility qualifications of any entrant and to disqualify any entrant found, in its sole discretion, to be tampering or otherwise interfering with this Contest. Any entrant found to be misrepresenting themselves through the use of aliases and/or addresses or an entrant's submission of mass entries and/or reproductions will be disqualified. Except where prohibited by law, by participating in this Contest, you are granting Dirtybird Records , and those acting under its authority, permission to use your name, photograph, voice and/or likeness for advertising, publicity and/or other business purposes in connection with the Contest without compensation. 6. JUDGING: Eligible entries will be judged by Dancetracks Digital, Ableton, and Dirtybird Records in addition to the public vote, via the remix website. All eligible entries will be listened to and rated by originality and creativity, technique, sonic quality and viability in the dance market. Winners will be determined on or shortly after September 20, 2008 by a combination of the public vote and the remixes selected by Dancetracks Digital, Ableton and Dirtybird Records. The winning remix will be selected by Dirtybird Records alone. The winning remix may or may not match the remix with the highest public vote. 7. NOTIFICATION: Winners will be notified by e-mail by the close of business September 25, 2008. Winners will have forty-eight (48) hours from the date of attempted notification to respond to the notification via telephone or e-mail. In the event that any Winner does not respond to the notification within this forty eight (48)hour period, that Winner will be deemed to have forfeited his/her win. The next highest rated entry will be chosen from the remaining eligible entries. Dirtybird Records is not responsible for late, lost or misdirected notification. Winners will be required to sign and return to Dirtybird Records an agreement of participation. Affidavits and Releases sent via facsimile will be accepted in order to comply with the referenced time constraint but the original must be mailed to Dirtybird Records contemporaneously. In the event that a Winner cannot be contacted, does not meet the eligibility requirements, or fails to return a complete, notarized Affidavit and Release within the specified time period, such Winners will be deemed in Dirtybird Records sole discretion, to have forfeited his/her win and chances to participate. 8. PRIZES: The Grand Prize Winner will have his/her remix released as a digital release on Dirtybird Records and also be awarded the first place prizes. Grand Prize Pack valued at two thousand five hundred dollars U.S. $2500.00. 9. Winner agrees that The Martin Brothers, Dirtybird Records and Dancetracks Digital, and their affiliated companies, parents, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents will have no liability whatsoever, and will be held harmless by Winner for any liability for any injuries, losses or damages of any kind to persons, including death, and property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of the prize, or participation in this Contest. 10. RULES: Entrants are encouraged to print out a copy of these official Contest rules for future reference. To receive a copy of these official Contest rules by mail, send the request with a self-addressed stamped envelope to Dancetracks Digital, Legal Department, 824 E. 17th Street Ste. 2, Brooklyn NY 11230. WINNER: Winner will be announced on the Dancetracks Digital website on or shortly after September 25, 2008. 12. * Dubpost Professional Mixing & Mastering session with private mixdown session to be held at their New York City facility by September 2009.
